ApeXhit LinkIT — End User License Agreement

This applies to any installed version of LinkIT — currently, that means the Progressive Web App (PWA) you can add to your device's home screen (for example, via "Add to Home Screen" on Android, or a similar browser-native install prompt), which then runs in its own window and launches like a native app. If LinkIT is ever distributed as a compiled native binary through an app store, this EULA will apply to that binary as well.

This End User License Agreement ("EULA") is a legal agreement between you and ApeXhit LLC for the LinkIT software application, including associated files, media, icons, and documentation (the "Software"). By installing, adding to your home screen, or otherwise using the installed Software, you agree to be bound by this EULA. This EULA supplements, and does not replace, the LinkIT Terms of Service.

1. Grant of License

Subject to your compliance with this EULA, ApeXhit LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software for your personal or internal business purposes on devices you own or control.

2. Restrictions

You may not:

Copy, modify, adapt, translate, or create derivative works of the Software; reverse-engineer, decompile, or disassemble the Software (except where applicable law expressly permits despite this restriction); sell, rent, lease, sublicense, distribute, or otherwise transfer the Software or your license to any third party; remove or alter any proprietary notices, labels, or the ApeXhit branding/icon embedded in the Software; or use the Software to build a competing product.

3. Ownership

The Software is licensed, not sold. ApeXhit LLC and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of ApeXhit LLC.

4. Updates

Because LinkIT is a Progressive Web App, updates to the underlying web application are typically delivered automatically the next time your device has an internet connection — you generally do not need to manually reinstall it. Some updates may be required for continued use or security. Your continued use of updated Software constitutes acceptance of any accompanying changes to this EULA or the Terms of Service.

5. Local Data and Permissions

The Software may request device permissions (e.g., local file/storage access for export-import/backup, camera/microphone access for attaching photos or voice recordings to notes, or network access for optional cloud sync). You may decline optional permissions, though some features may not function without them.

6. Third-Party Components

The Software may include open-source or third-party components licensed under their own terms, which are incorporated by reference. A list of such components and their licenses will be made available within the app or upon request.

7. Term and Termination

This license is effective until terminated. It terminates automatically if you fail to comply with any term of this EULA. Upon termination, you must uninstall (remove from your home screen) and destroy all copies of the Software in your possession.

8. No Warranty; Limitation of Liability

The Software is provided "AS IS" without warranty of any kind, to the fullest extent permitted by law, as further described in the Disclaimers and Limitation of Liability sections of the LinkIT Terms of Service, which apply equally to this EULA.

9. Export Compliance

You agree to comply with all applicable U.S. and international export control laws in your use of the Software.

10. Governing Law

This EULA is governed by the laws of the State of Florida, consistent with the Governing Law section of the LinkIT Terms of Service.
